U.S. Bank National Association (named in the complaint, not a defendant) · Governance finding · severity 2 of 5

Four U.S. Bank account holders filed a proposed class action against Pegasystems Inc. in the District of Massachusetts on 2 October 2026, alleging that Pega Voice AI, which U.S. Bank uses in its contact centres, routed live customer-service call audio to Pega's cloud, transcribed it and analysed it with natural language processing without callers' consent. The complaint claims violations of California's Invasion of Privacy Act and the Massachusetts and Pennsylvania wiretap statutes and seeks statutory damages. U.S. Bank is not a defendant: the suit is against Pegasystems alone, although it alleges that neither Pega nor U.S. Bank obtained callers' consent. No court has ruled, and no public response from Pegasystems or U.S. Bank was found as of October 2026.

Impact

Proposed classes of U.S. Bank callers in California, Massachusetts and Pennsylvania; no number of callers is given in the public record. · Allegations only. The complaint cites statutory damages of $5,000 per CIPA violation and, under the Pennsylvania act, the greater of $100 a day or $1,000; nothing has been awarded.

What happened?

The complaint (No. 1:26-cv-14506) was filed on 2 October 2026 by four U.S. Bank account holders from California, Massachusetts and Pennsylvania who say they called U.S. Bank's customer-service lines between December 2025 and August 2026 and discussed account details with human agents. The only defendant is Pegasystems Inc., a Massachusetts software company; U.S. Bank National Association is named in the complaint as Pega's customer but is not sued.[1][2]

According to the complaint, Pega Voice AI is "an artificial intelligence tool" that assists agents during live calls. It alleges that in U.S. Bank's deployment, call audio is routed to Pega's Speech Service in Pega Cloud for real-time transcription, and transcripts are processed by Pega's natural language processing and suggestion components to prompt agents, fill forms and produce summaries and analytics. The complaint cites Pega's own published U.S. Bank case study for the deployment.[2][4]

The plaintiffs allege that callers expected to speak only with U.S. Bank, that neither Pegasystems nor U.S. Bank told them a third party was receiving and analysing the call, and that Pega therefore acted as an eavesdropper under California Penal Code sections 631 and 632, Mass. Gen. Laws ch. 272, § 99, and Pennsylvania's Wiretapping and Electronic Surveillance Control Act. The complaint also alleges Pega can use call content to train and improve its AI models.[2]

The lead plaintiff had earlier sued Pegasystems in the Central District of California on 12 February 2026 (No. 2:26-cv-01500); Pegasystems moved to dismiss that case for lack of jurisdiction, and the docket's final entry, on 30 July 2026, is a jurisdictional dismissal entry whose text is not public. The public docket does not show whether that case also concerned U.S. Bank calls. In Massachusetts, a summons was returned executed on 16 October 2026; no response from Pegasystems had been filed as of 21 October 2026.[1][3]

No public statement found as of 2026-10-21 from Pegasystems or from U.S. Bank, which is not a party to the suit (searched news coverage, the D. Mass. and C.D. Cal. dockets and the companies' newsrooms). Pegasystems had not yet filed a response in court.[1]

What was the outcome, and did regulators act?

Pending at the pleading stage in the District of Massachusetts; no ruling, settlement or regulatory action. U.S. Bank faces no claims in this case.[1]

Is U.S. Bank being sued over Pega Voice AI?

No. The only defendant in Juarez v. Pegasystems Inc. is Pegasystems. The complaint names U.S. Bank as the customer that uses Pega Voice AI in its contact centres and alleges that neither company obtained callers' consent, but it brings no claims against U.S. Bank.

What does the Pega Voice AI lawsuit allege?

It alleges that Pega Voice AI receives live audio of U.S. Bank customer-service calls in Pega's cloud, transcribes it in real time and analyses it with natural language processing to prompt agents, without telling callers or getting consent, in breach of California, Massachusetts and Pennsylvania wiretap laws.

Did anyone lose money because of the Pega Voice AI calls?

No financial loss is alleged. The suit seeks statutory damages for privacy violations, which these wiretap laws allow without proof of loss. Nothing has been awarded; the case was filed in October 2026 and Pegasystems had not responded as of 21 October 2026.
