Svea Bank AB and Resurs Bank AB · Governance finding · severity 3 of 5

On 21 June 2022 Sweden's Finansinspektionen (FI) issued remarks and fines of SEK 45 million to Svea Bank (for its merged subsidiary Svea Ekonomi) and SEK 50 million to Resurs Bank over unsecured consumer loans of SEK 80,000–400,000 applied for in June–September 2019. Per FI, both lenders' credit assessments were largely automated: initial decline rules, then score models estimating the probability of non-payment from variables such as age, income and housing type, and a debt-ratio limit. FI found the banks ignored applicants' mortgages and their housing, existing-loan and child costs, breaching the Consumer Credit Act. Both banks won at first instance in November 2023, but the Administrative Court of Appeal reinstated FI's decisions in 2024 and the Supreme Administrative Court refused leave. The models were automated statistical tools, not described as AI.

| Severity | 3 of 5 — A regulatory finding with fines of SEK 45 million and SEK 50 million across two banks for unsecured loans of SEK 80,000–400,000 granted on insufficient information; upheld by the Administrative Court of Appeal and final after the Supreme Administrative Court refused leave in December 2024. |

## What happened?

FI examined granted loans of SEK 80,000 to 400,000 that consumers had applied for between June and September 2019. For Svea, FI's sample covered 113 loans across two unsecured products, one of them aimed at people with payment remarks. [1][6]

FI described both processes in near-identical terms. On Svea Ekonomi: "Kreditprövningsprocessen har i stor utsträckning varit automatiserad" (the credit-assessment process has to a large extent been automated). After initial decline criteria, such as income level and debts registered with the Enforcement Authority, the company used a score model estimating the probability of a credit loss within twelve months from variables including age, income and housing type, plus a debt-ratio ceiling on how much an applicant could borrow; only in some cases was a manual check made. For Resurs, FI found the same: initial checks on age, payment remarks and enforcement debts, then one of three score models estimating the probability of a payment 90 days late twelve months after payout, and a debt-ratio model. [4][6]

FI found that both lenders took account only of debts registered with the credit-reference agency UC, disregarded the size of any mortgages, and did not consider applicants' costs for housing, existing loans or children. Resurs also accepted gaps of up to 30 percent between stated and assessed income on loans up to SEK 150,000 without further checks. FI concluded that the assessments were not based on sufficient information about consumers' finances, breaching sections 12 and 6 of the Consumer Credit Act. "The fact that the firms completely disregarded key information about consumers' expenses and did not even consider any mortgages is notable," said deputy director general Susanna Grufman. [1][2][4]

Both banks appealed. In court Svea argued that its scoring models were statistically effective and that the omitted data added nothing to predicting repayment. FI replied that it had not objected to the model as such and that "Att bedöma om en konsument sannolikt kommer att återbetala en kredit, vilket är det en scoremodell gör, är inte samma sak som att bedöma om konsumenten har ekonomiska förutsättningar att återbetala krediten" (assessing whether a consumer is likely to repay, which is what a score model does, is not the same as assessing whether the consumer has the financial means to repay). The Administrative Court in Stockholm overturned both decisions on 14 November 2023. [5][6]

On FI's appeal, the Administrative Court of Appeal in Stockholm reinstated the Resurs decision on 5 June 2024 and the Svea decision on 25 September 2024. In the Svea case it said it did not question that the bank's model was built on scientifically tested methods or could complement a credit assessment, but the data the bank ignored were so central that individual consumers risked over-indebtedness. On 13 December 2024 the Supreme Administrative Court refused both banks leave to appeal, making the decisions final. [6][7][8][9]

## Timeline

- Jun 2019 — Start of the June–September 2019 application window from which FI sampled granted loans at Svea Ekonomi and Resurs Bank. [1]
- Jun 21, 2022 — FI's board issues remarks and fines of SEK 45 million (Svea Bank) and SEK 50 million (Resurs Bank). [1][2][3]
- Nov 14, 2023 — The Administrative Court in Stockholm overturns FI's decisions against both banks. [5][6]
- Jun 5, 2024 — The Administrative Court of Appeal reinstates FI's decision against Resurs Bank. [7]
- Sep 25, 2024 — The Administrative Court of Appeal reinstates FI's decision against Svea Bank. [6]
- Dec 13, 2024 — The Supreme Administrative Court refuses both banks leave to appeal; the fines are final. [8][9]

## What was the impact?

- Financial: SEK 95 million in fines (SEK 45 million Svea Bank, SEK 50 million Resurs Bank)
- Customers: Consumers granted unsecured loans of SEK 80,000–400,000; FI's Svea sample covered 113 loans. No count of borrowers harmed or over-indebted is given in the record.
- Other: The Administrative Court of Appeal found that Svea's breaches meant individual consumers risked over-indebtedness. [1][6]

## How did Svea Bank AB and Resurs Bank AB respond?

Both banks disputed the findings. Per FI's decision, Resurs maintained that its credit assessments rested on sufficient information but told FI it would raise its minimum income requirement from SEK 100,000 to SEK 140,000, check stated incomes that differed by more than 15 percent from assessed income, collect data on dependent children, add a left-to-live-on (KALP) calculation and update its debt-ratio model. Svea argued in court that the omitted data added nothing to its statistically effective scoring models and that its process did not create a risk of over-indebtedness; FI noted in mitigation that the bank had made corrections. [4][6]

## What was the outcome?

Both remarks and fines are final after the Supreme Administrative Court refused leave on 13 December 2024. The courts did not ban score models; they held that for large unsecured loans a lender must also gather central information on the applicant's debts and costs. [6][8][9]

## FAQ

### Why did Finansinspektionen fine Svea Bank and Resurs Bank?

Because their largely automated, score-based credit checks on unsecured loans of SEK 80,000–400,000 ignored applicants' mortgages and their housing, existing-loan and child costs. FI found the assessments were not based on sufficient information, breaching the Consumer Credit Act, and fined them SEK 45 million and SEK 50 million.

### Were the Svea and Resurs credit models AI?

No one on the record called them AI. FI and the courts described rule-based decline criteria, statistical score models that estimated the probability of non-payment from variables such as age, income and housing type, and debt-ratio limits. This register classes them as automated systems not described as AI.

### Did the banks win their appeals?

Only at first instance. The Administrative Court in Stockholm overturned both decisions in November 2023, but the Administrative Court of Appeal reinstated them in June 2024 (Resurs) and September 2024 (Svea), and the Supreme Administrative Court refused leave to appeal on 13 December 2024.

### Did the courts say score models cannot be used for credit decisions?

No. The appeal court said it did not question that Svea's model rested on scientifically tested methods or could complement an assessment. Its point was that for large unsecured loans a model alone was not enough when central facts such as mortgages were left out.
